1. Agreement
These Terms of Service (“Terms”) apply to your use of Skan Africa (“Skan”, “the Service”, “we”, “us”, or “our”).
Skan Africa is currently an early-stage beta product and is not yet operated through a registered limited liability company. Until a company or business entity is formally registered, the Service is operated by Jesse Nyemitei, Chidinma Akunwa, Roddiyyat Taiwo, located in Ghana.
By creating an account, using the app, scanning a product, or accessing the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
When Skan Africa is later incorporated or otherwise formally registered, we may update these Terms so that the registered entity becomes the contracting party.
2. What Skan is, and what it is not
This section is very important. Please read it carefully.
Skan reads packaged-food labels and presents information about the product in relation to a health profile selected or created by you. The Service is designed to help users better understand packaged-food information.
Skan is not medical advice.
Skan does not diagnose, treat, prevent, or manage any disease or health condition. Skan is not a substitute for a doctor, registered dietitian, pharmacist, nutritionist, or any qualified health professional.
Skan does not tell you whether you must eat or must not eat a product. It gives you information, explains the basis for that information where possible, and leaves the final decision to you.
The analysis may be wrong, incomplete, outdated, or based on a label that was difficult to read. You must not rely on Skan as your only source of information about a product.
For decisions about your health, diet, medication, treatment, or disease management, speak to a qualified healthcare professional. If you have a medical emergency, contact a medical professional or emergency services immediately. Do not start, stop, or change medication or treatment based on anything shown in the Service.
3. Beta nature of the Service
Skan is currently a beta product. This means the Service is still being tested, improved, and validated.
You understand that:
- features may change, break, be removed, or become unavailable;
- analysis may be limited while we improve the product;
- some results may be experimental;
- the Service may be unavailable from time to time;
- we may limit access, suspend testing, or close the beta at any time.
The beta is provided for general informational and product-testing purposes only.
4. Eligibility and age
You must be at least 18 years old to create an account or use the Service.
If you create or manage a profile for another person, including a child, parent, relative, patient, or person in your care, you confirm that you have the right or authority to provide that person’s information for use in the Service.
You must not enter another person’s health information without permission or legal authority.
5. Accounts and anonymous use
Some parts of the Service may be available without an account. To unlock health-profile-based analysis, save scans, or access personalised features, you may need to create an account.
You agree to provide accurate information, keep your login details secure, and take responsibility for activity under your account.
If you believe your account has been accessed without permission, contact us promptly at support@skan.africa.
6. Health profiles and your responsibility
The usefulness of the Service depends partly on the accuracy of the information you provide.
You are responsible for the health-profile information you enter, including any condition, dietary preference, allergy, sensitivity, medication-related concern, or other profile information.
Skan may use thresholds, rules, or guidance drawn from public health sources, food-label data, nutrition research, and other sources we consider relevant. These thresholds are general guidance values. They are not personalised clinical advice and may not be suitable for your specific medical situation.
If you are unsure whether a product is safe or appropriate for you, ask a qualified healthcare professional.
7. Video consultations
If you book a paid consultation with a dietitian through the Service, the consultation is carried out over a live video call.
The video call is provided through a third-party video-call provider, not Skan's own servers. This means:
- your call may be routed through servers located outside Ghana;
- your connection is always encrypted in transit;
- the video-call provider states that it does not record or store your call — video and audio pass through only in real time, and no recording or storage of the call video/audio itself is enabled by default; the one exception is the separately-consented AI note-taking feature described below, which processes (but does not itself store) real-time audio to produce a transcript.
Before your first video consultation, you will be asked to separately review and accept these terms specific to video consultations.
AI-assisted consultation notes. With the separate, specific consent of both the patient and the dietitian, an AI assistant may join the call to transcribe the conversation and generate written notes for the dietitian's records. This is optional, off by default, and either party can withdraw consent at any time from Settings — see our Privacy Policy Section 4.9 for details on how this works.
Google Calendar sync (dietitians). A dietitian may optionally connect their Google Calendar to sync availability and booked consultations. This is a separate step from signing in with Google, and only accesses free/busy time and creates/deletes generic booking events — see our Privacy Policy Section 4.11 for details.
8. Payments and fees
Some parts of the Service, such as a paid consultation, require payment. Dietitians may also be charged a recurring fee for certain tracking or subscription features, or may receive payouts for consultations they provide.
Payments are processed by third-party payment processors (currently Moolre for mobile money, and Paystack for card payments and dietitian payout splits) — we do not ourselves store your full card number, mobile money PIN, or equivalent payment credentials.
By making a payment or receiving a payout through the Service, you agree to the applicable payment processor's own terms in addition to these Terms.
Refunds, disputes, and payout timing. [To be finalised — this section will describe our refund policy, how payment disputes are handled, and payout timing for dietitians, before the Service is made broadly available. Contact support@skan.africa with any payment question in the meantime.]
9. Dietitians using the Service
If you use the Service as a dietitian, in addition to the rest of these Terms:
- you confirm that you hold any professional qualification, licence, or registration required to provide dietary or nutrition advice in your jurisdiction;
- you are responsible for the professional accuracy and appropriateness of advice you give during a consultation — Skan provides the platform, not the advice itself;
- actions you take on a patient's record (such as viewing, editing, or linking) may be logged in an audit trail for accountability and safety purposes;
- [Payout terms, commission/fee structure, and professional-conduct expectations specific to dietitians are to be finalised and will be added here before the Service is made broadly available.]
10. Product scans and label information
The Service works by reading information from packaged-food labels or product data sources.
You understand that:
- the label image may be blurry, incomplete, damaged, folded, obstructed, or difficult to read;
- the product may have changed formulation after the label or data source was created;
- manufacturers may make errors or omit information on labels;
- some products may not provide full nutrition, ingredient, allergen, or additive information;
- the Service may not detect every relevant health concern.
Where the label cannot be read clearly, the Service may say that the information is insufficient. Where nutrition information is missing, the Service may also say that the information is insufficient rather than inventing a result.
You should always check the physical product label yourself before making a purchase or consumption decision.
11. Brand alternatives and sponsored suggestions
The Service may suggest other products that appear to be more aligned with the selected profile or scan context.
A product suggestion is informational only. It is not medical advice, dietary advice, or a recommendation that you should consume the product.
In the future, some suggested products may come from brands, retailers, or partners that have a commercial relationship with us. Where a suggestion is sponsored, paid for, promoted, or influenced by a commercial arrangement, we will aim to make that clear in the Service.
We do not sell or give your identity or health-profile information to brands for them to contact you directly. Our handling of personal data is explained in our Privacy Policy.
12. Acceptable use
You agree not to:
- use the Service unlawfully or for a harmful purpose;
- upload content you do not have the right to upload;
- enter false, misleading, or unauthorised information;
- attempt to reverse engineer, copy, scrape, overload, interfere with, or disrupt the Service;
- use automated tools to access the Service without our permission;
- attempt to bypass usage limits, security controls, or account restrictions;
- use the Service to harm, mislead, harass, or exploit another person;
- use outputs from the Service as professional medical, nutrition, or clinical advice.
We may suspend, restrict, or terminate access if we believe these Terms have been breached or if continued access creates risk to users, the Service, or the public.
13. Intellectual property
The Service, including its software, design, interface, workflows, analysis structure, branding, and original content, belongs to us or our licensors.
We grant you a limited, personal, revocable, non-transferable licence to use the Service for its intended purpose.
You may not copy, sell, sublicense, modify, reverse engineer, or create derivative works from the Service without our written permission.
Food labels, brand names, logos, packaging, and product materials belong to their respective owners. Their appearance in the Service does not mean they endorse or are affiliated with Skan unless we clearly state otherwise.
14. User content and scans
When you upload a product image, label image, or related content, you confirm that you have the right to upload it.
You allow us to process the uploaded content to provide the Service, improve product performance, troubleshoot issues, detect abuse, and improve label-reading accuracy.
Where reasonably possible, we will handle uploaded content in line with our Privacy Policy and applicable data-protection obligations.
Do not upload images that contain private information about another person unless you have the right to do so.
15. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of your agreement with us.
Because the Service may process health-profile information, you should read the Privacy Policy carefully before using the Service.
If you do not want us to process health-profile information, do not create a health profile or use condition-specific features.
16. Accuracy and limitations
The Service is provided for general information only.
We do not guarantee that:
- any scan result is accurate, complete, current, or suitable for your circumstances;
- the Service will identify every ingredient, additive, allergen, nutrition value, or risk factor;
- a product suggestion will be healthier, safer, cheaper, available, or suitable for you;
- the Service will always work without interruption or error.
You remain responsible for your food choices, health decisions, and use of the information shown in the Service.
17. Disclaimers
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, or suitable for your particular needs.
Nothing in these Terms is intended to exclude any liability that cannot lawfully be excluded.
18. Limitation of liability
To the fullest extent permitted by Ghanaian law, we will not be liable for indirect, incidental, special, consequential, or punitive loss arising from your use of, or inability to use, the Service.
We are not liable for harm arising from:
- reliance on a scan result;
- reliance on a product suggestion;
- incorrect, incomplete, outdated, or unreadable product-label information;
- decisions you make about food, diet, health, medication, treatment, or disease management;
- unauthorised use of your account where you failed to keep your login details secure.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence where such limitation is not permitted by law.
19. Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, your breach of these Terms, your unauthorised upload of another person’s information, or your violation of applicable law.
This applies only to the extent permitted by law.
20. Suspension and termination
You may stop using the Service at any time.
You may request deletion of your account by contacting us or using any account-deletion feature available in the app.
We may suspend, restrict, or terminate your access if:
- you breach these Terms;
- your use creates risk to other users, the Service, or us;
- we are required to do so by law;
- the beta test is paused, discontinued, or materially changed.
Sections that by their nature should continue after termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnity, and dispute provisions.
21. Changes to the Service and these Terms
We may update the Service and these Terms from time to time.
If we make a significant change, we will aim to notify users through the app, website, email, or another reasonable method.
By creating an account, you agree that we may email you about significant product updates and new features. You can opt out of these emails at any time using the unsubscribe link included in the first such email you receive, or from your account settings.
The updated Terms will apply from the effective date stated in the updated version. If you continue using the Service after the updated Terms take effect, you accept the updated Terms.
22. Governing law and disputes
These Terms are governed by the laws of the Republic of Ghana.
Any dispute arising from or relating to these Terms or the Service will first be addressed through good-faith discussions between you and us.
If the dispute cannot be resolved informally, it will be handled by the courts of Ghana, unless a different dispute-resolution process is required by applicable law or later agreed in writing.
